1. DEFINITIONS

1.1TERMS, refers to the text of this TERMS.

1.2 Game Rules: These refer to the user codes, player regulations, game announcements, tips, notifications, and other contents issued and updated periodically by the Game's Service Provider.

1.3 Game's Service Provider: This refers to Rush One Technologies, Inc, herein referred to as "we" or "us" in these TERMS. We are the entity providing you with the Game and its associated Services.

1.4 You: Also referred to as "player(s)" or "user(s)", this refers to any natural person authorized to use the Game and its Services.

1.5 Game Data: This refers to all types of data generated during your use of the Game and recorded by the servers. This includes, but is not limited to, character data, virtual item data, behavior logs, purchase logs, and other relevant data.

1.6 Coins: The Services may include a virtual, in-game tokens ("Coins") including, but not limited to chips, coins, credits, or points, that may be provided for completing tasks, or watching advertisements. Coins cannot be withdrawn or converted into real currency,which can only be used within the game.

2. GAME ACCOUNT

2.1 Guest Account Limitations: You acknowledge and agree that guest accounts may not allow for game account recharges or purchases. Upon uninstalling/reinstalling the Game, replacing your terminal device (e.g., mobile phone or computer), or in case of device damage, all Game Data generated using a guest account may be deleted and cannot be retrieved. You are responsible for any losses resulting from these circumstances.

If you use a third-party account recognized by the Game as your Game Account, you must comply with the terms and rules of that third-party account. Any issues arising from the use of your third-party account, including but not limited to account theft, should be resolved with the third party. The Game may provide assistance as appropriate.

2.2 Account Security: You fully understand and agree that the Game has the right to verify the authenticity and validity of user registration information, and to take reasonable technical and administrative measures to ensure account safety and validity. It is your responsibility to safeguard your account and password and use them securely. Failure to do so may result in legal liability for any damage caused to your or others' civil rights.

2.3 Unused Accounts: To ensure effective use of server resources, if you do not log into the Game using your account for three years, we reserve the right to take measures such as deleting your account, Game Data, and related information upon prior notification.

2.4 Account Ownership and Use: The game account is your authorization to log into and use the Game and related services in accordance with these TERMS. Ownership of the account belongs to us. You have the right to use the account only in accordance with these TERMS and any other relevant account usage TERMS or special rules issued by us. You must not provide your account to others for any use, including but not limited to assigning, leasing, or lending your account for commercial purposes such as live broadcasting, video recording, surrogate gaming, or other commercial activities. Any legal consequences or liabilities arising from such actions are your responsibility, and we reserve the right to take punitive measures against your account, including but not limited to issuing warnings, restricting or prohibiting the use of all or part of your account's functions, deleting your account and Game Data, and banning or cancelling your account. You are responsible for all resulting losses.

2.5 Account Cancellation: If the Game provides an account cancellation function and you wish to cancel your account, follow the official account cancellation guidelines. Ensure you meet the officially announced conditions for account cancellation and agree to the official account cancellation TERMS and other relevant rules. Please note that upon account cancellation, any related game revenue will be cleared. Ensure you have properly handled or settled any game revenue before cancelling. If any game revenue remains upon cancellation (including revenue generated during or expected in the future), we reserve the right to clear it, and you assume the consequences. This includes but is not limited to game membership rights and levels, character growth and upgrade data, unused virtual currency and items, purchased but unused value-added services, and any other game revenue.

3. GAME SERVICE

3.1 Service License: Subject to your compliance with these TERMS and relevant laws and regulations, we grant you a personal, non-transferable, and non-exclusive license to use our Service. You may use our Service solely for non-commercial purposes, including:

Receiving, downloading, installing, launching, upgrading, logging into, displaying, running, and/or taking screenshots of the Game.

Creating a game character, setting an online name, viewing Game Rules, user profiles, and game battle results, creating a game room, setting game parameters, purchasing or using game items, equipment, currency, and other features, as well as utilizing chat and social sharing functions.

Using one or several other functions supported and authorized by the Game.

3.2 Content Sharing: During your use of the Game's Service, you may not record, broadcast, or share Game content without our permission, including but not limited to streaming or broadcasting the Game through any third-party software.

3.3 Reserved Rights: All rights not expressly authorized in this or other clauses of these TERMS are reserved by us. You must obtain our separate written approval before exercising any such rights.

3.4 Game Items and Equipment: You fully understand and agree that game equipment, currency, and other items are part of the Game's Service and are licensed to you under these TERMS. Your purchase and use of these items must comply with these TERMS and game-specific rules. Items may expire after a certain period, even if unused. Unless due to force majeure or reasons attributable to us, they will expire automatically at the end of the validity period. We reserve the right to adjust, update, or optimize game content, including but not limited to character design, performance, and related numerical settings.

3.5 Account Security: To protect your account security and create a fair gaming environment, we may access your device's RAM and other parallel programs through technical means. If we detect any unauthorized or harmful programs that hinder the Game's Service, we reserve the right to collect relevant information and take reasonable measures. We do not intend to process or access any personal or sensitive information during this process.

3.6 Minor Protection: In accordance with laws and regulations, we take measures to protect minors' rights while using the Game's Service, including restricting inappropriate content, limiting gaming time, and preventing addiction. We publish User Guidelines and warnings, including game introductions, proper usage, and harm prevention tips. Minors should read and follow these guidelines under parental guidance. Other players should avoid content that may harm minors' physical or mental health.

3.7 Anti-Addiction Measures: You acknowledge and agree that we may incorporate your account into an anti-addiction system and take corresponding measures if:

•The system determines you are under 18 years old.

•You log in as a guest.

•Other laws, regulations, or policies require inclusion, or we have reasonable grounds to believe it is necessary.

To further prevent minors from impersonating others, we may enable face recognition in some games or for select users. If required and you fail or refuse verification, your account will be included in the anti-addiction system.

Regarding the accounts that fall into the anti-addiction system, the Game is entitled to take one or several of the following measures in accordance with the stipulations of the relevant laws, regulations and policies, the terms of other clauses of this TERMS, the operation strategy of the Game, or the reasonable requests of your parent or legal guardian:

·providing your parent or legal guardian with related information about your game (including but not limited to log-in information of your game account, recharging and consumption information, and so forth), so that your legal guardian can be informed of your gaming situation timely or simultaneously;

·limiting the consumption cap of your game account;

·adopting technical measures to block certain games or certain functions of the Game or limiting the gaming time or duration for you;

·canceling or deleting your game account, Game Data and other related information;

·taking any other reasonable measures following the request of your parent or legal guardian or the reasonable discretion of the Game to restrict or prohibit your use of the Game; and

·relevant measures required by relevant laws, regulations or policies.

3.8 Service Fees: The provision of the Game's Service is a commercial activity. You have the discretion to decide whether to pay associated fees to access specific services, based on our unilaterally published fee schedule (including but not limited to purchasing in-game virtual items and other value-added services). If you fail to pay according to the applicable rates, you may not be able to access certain game services.

You acknowledge and agree that changes or adjustments to charging items or rates are normal business practices and that you will not hold us liable for any such changes or adjustments. 

You acknowledge and agree that, if you use legal tender to recharge and make purchase in the game or to exchange for game virtual currency, virtual props and other virtual items or value-added services, you are deemed to have purchased the Game's Services, and the game virtual currency, virtual props and other virtual items or value-added services you purchased or exchanged will be non-refundable and will not be exchanged into legal tender again, unless otherwise prescribed by mandatory provisions in law.

3.9 Force Majeure: We shall not be liable for any damage you suffer due to force majeure events while using the Game's Service. Such events include but are not limited to laws, regulations, government policies, orders from state agencies, other government actions, or unforeseeable, unavoidable, and insurmountable events such as earthquakes, floods, snowstorms, fires, tsunamis, typhoons, strikes, wars, and the like.

3.10 Data Abnormalities: The Game may encounter software bugs, version update flaws, third-party virus attacks, or other factors that may lead to data abnormalities in game characters, items, equipment, and currency in your game account or Game Data. In such cases, we reserve the right to temporarily freeze your game account until the cause of the abnormality is identified. If the abnormality is determined to be caused by abnormal game behavior, we may restore your Game Data to its original state before the abnormality occurred (including requesting a rollback of Game Data from a third party). Under these circumstances, we shall not be responsible for any resulting consequences. If the data abnormality is due to your violation of laws, regulations, or these TERMS, we reserve the right to take one or more measures specified herein.

3.11 Third-Party Transactions: The Game does not authorize you to obtain game accounts, items, equipment, currency, or other game services from third parties through purchase, gifts, or other means. We are not responsible for any third-party transactions and will not entertain complaints arising from such transactions.

4. SOFTWARE LICENSE

4.1 Software Acquisition: To use the Game's Service, you may need to download and install relevant software. You can obtain the software directly from our official websites or authorized third parties. If you acquire the Game or a similarly named game from an unauthorized third party, you are deemed to not have a license from us, and we cannot guarantee its normal operation or compensate you for any resulting damage.

4.2 Software Versions: We may develop different software versions for various terminal devices or operating systems, such as Windows, iOS, Android, Windows Phone, Symbian, Blackberry, Nintendo Switch, and others. Choose the appropriate version based on your device and operating system, and follow the installation instructions correctly.

4.3 Software License: If the Game is provided as software, we grant you a personal, non-transferable, and non-exclusive license to use it on a single terminal device for non-commercial purposes only.

4.4 Additional Software: To provide a better and safer service, we may recommend installing additional software during the installation process. You may choose whether to install these.

4.5 Software Uninstallation: If you no longer need the software or wish to install a newer version, you can uninstall it yourself. If you wish to help us improve our products and services, please share your reasons for uninstalling.

4.6 Software Updates: To ensure service security and functional consistency, we reserve the right to update the software and modify or limit certain functional effects.

4.7 Older Versions: After a new software version is released, older versions may become incompatible. We cannot guarantee the continued usability or client services of older versions. Please regularly check for and download the latest version.

5. USERS’ CODE OF CONDUCT

5.1 Account Responsibility: You fully understand and agree that you are responsible for all actions taken using your game account, including any content you post and the consequences thereof.

·5.2 Intellectual Property and Legitimate Interests: Aside from using the Game's Service in accordance with these TERMS, you shall not engage in any activities that infringe upon our intellectual property rights or harm our legitimate interests or those of other third parties.

·5.3 Compliance with Laws and Regulations: You shall comply with all applicable laws and regulations while using the Game or its Service. You shall not use the Game or its Service to engage in any illegal conduct, including but not limited to the following: 

·opposing the fundamental principles determined by the Constitution;

·jeopardizing the unity, sovereignty and territorial integrity of the state;

·divulging state secrets, undermining state security or damaging the honor or interests of the state;

·inciting hatred or discrimination among ethnic groups, undermining the solidarity among ethnic groups, or disrespecting ethnic customs and practices;

·promoting heresy or superstition;

·spreading rumor, creating social disorder or harming social stability;

·advocating obscenity, pornography, gambling, violence, or abetting the commission of a crime;

·insulting or defaming others or infringing any legitimate rights of others;

·harming social morality;

·containing any other content prohibited by any law, administrative rule or relevant regulation.

5.4 You explicitly understand and agree to the following rules:

a.Our games are solely for your entertainment purposes. You shall not utilize our games and related services for any profit-making activities, nor shall you engage in gambling, operating a gambling business, or other illegal activities using them. Additionally, you must refrain from providing any facilitation or conditions to other users to engage in the aforementioned profit-making or illegal activities.

b. Except as otherwise stipulated by relevant laws, regulations or policies, the Game does not provide any form of official repurchase, direct or disguised exchange of cash or physical objects, mutual gift, transfer and other services and related functions for the virtual currency, points and other virtual props in our games. At the same time, you must not violate the relevant regulations of the state and the Game to trade virtual currency, points or other virtual props in the game, offline or through other platforms in any way.

c. During your use of our games, we reserve the right to limit the amount of game coins, points, or other virtual game props consumed per game account, as well as restrict the daily recharge limit and gameplay duration of each account, in accordance with relevant laws, regulations, or policies. We have the authority to establish specific restrictions or limitations on gameplay based on compliance with applicable regulations.

d. You are prohibited from engaging in any illegal activities or infringing upon the legitimate rights and interests of our company or other third parties.

5.5 You acknowledge and agree that if the Game implements account banning measures against your game account in accordance with these TERMS, the Game has the authority to determine the duration of the ban based on the severity of your violation.

You further acknowledge and agree that: (1) during the period of account banning, the virtual game currency, equipment, items, and other virtual assets in your game account may become unusable; (2) if these virtual assets have a specific expiration date, that date may expire during the account banning period, rendering them unusable even after the banning period ends.

5.6 You acknowledge and agree that, the sale, collusion with others to sell, cash out, or engage in disguised transactions involving virtual currency, virtual goods, or other virtual items is prohibited in this game. The game does not offer services to refund, exchange, or convert virtual goods into real gold or any other form of currency. If a user is found to engage in the aforementioned prohibited behaviors, their account will be immediately closed, and their virtual currency frozen. If these actions involve illegal criminal activities, they will be referred to the judicial authorities for processing.

5.7 You acknowledge and agree that, the Game prohibits the sending or organizing of gambling, the sale of gambling tools, and the imparting of gambling skills and methods. If a user is found to be engaging in the aforementioned prohibited behaviors, their account will be immediately closed.

You acknowledge and agree that the Game strictly prohibits users from engaging in fraudulent activities disguised as online or offline virtual currency transactions. If a user is discovered engaging in such prohibited behaviors, their account will be promptly terminated, and their virtual currency will be frozen. Furthermore, if these actions constitute illegal criminal activities, the matter will be referred to the judicial authorities for appropriate legal action.

6. INTELLECTUAL PROPERTY

6.1 Ownership of Intellectual Property Rights: We own all intellectual property rights in and to the Game. This includes copyrights, trademarks, patents, trade secrets, and other intellectual properties, as well as our legitimate rights and interests (including but not limited to the Game itself, its art, music, text, and other game elements and components, and the dynamic visuals presented during gameplay). All information and content related to the Game (such as texts, images, audios, videos, graphics, interface designs, layout frameworks, related data, and electronic documents) are protected by applicable local laws, regulations, and international treaties. Except for rights enjoyed by relevant right owners under the law, we retain all aforementioned intellectual property rights and legal rights. Without our prior written consent, you may not use the Game for commercial purposes or disseminate its content through information networks.

6.2 Ownership of Game Data: Notwithstanding any other provisions in these TERMS, the ownership and intellectual property rights of Game Data generated during your use of the Game's Service belong solely to us. We have the right to store and dispose of Game Data. Our retention period for users' purchase records of game virtual currency will comply with relevant laws and regulations. Unless otherwise stipulated by state laws and regulations, the retention period for other Game Data shall be determined solely by us.

6.3 Third-Party Intellectual Property Rights: The Game may involve third-party intellectual property rights. If such a third party has any requirements regarding intellectual property rights that you may use in the Game under these TERMS, we will inform you of those requirements in an appropriate manner, and you must comply with them

7. COMPLIANCE WITH LOCAL LAWS AND REGULATIONS

7.1 Compliance with Local Laws and Customs: During your use of the Game's Service, you must abide by local laws, regulations, and respect local ethics and customs. If your conduct violates any local laws, regulations, or moral customs, you shall be solely responsible for the consequences that arise from such violations.

7.2 Avoidance of Political and Public Incidents: You should refrain from involving the Game in political or public incidents through your use of the Game's Service. If you do so, we reserve the right to suspend or terminate the provision of services to you. 

8. JURISDICTION AND APPLICABLE LAW

8.1 Jurisdiction of Agreement: This TERMS is executed in the USA.

8.2 Governing Law: The formation, validity, performance, interpretation, and dispute resolution of this TERMS shall be governed by the laws of the USA (excluding its conflict of laws rules).

8.3 Dispute Resolution: In the event of any dispute or controversy, the parties shall first endeavor to resolve such dispute or controversy through amicable negotiations. If a dispute cannot be settled through negotiations, you agree that it shall be submitted to and finally resolved by the competent court having jurisdiction at the place where this TERMS was executed.

8.4 Clause Headings: The headings of clauses in this TERMS are for ease of reference only and do not have substantive meaning. They shall not be used as a basis for interpreting the provisions of this TERMS.

8.5 Severability: If any provision of this TERMS is deemed invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and binding on both parties. 

9. MISCELLANEOUS

9.1 Amendment of TERMS: We reserve the right to amend the terms of this TERMS when deemed necessary. You can find the latest version of this TERMS on the relevant webpage. By continuing to use the Game's Service after any amendments to these TERMS, you will be deemed to have accepted the amended TERMS.

9.2 Advice for Responsible Gaming: We remind you to avoid inappropriate games and reject pirated games. Always prioritize self-protection and be vigilant against fraud. Play games in moderation to relax your mind and avoid addiction. Arrange your time reasonably to enjoy a healthy lifestyle.
